Terms of Service

1. General Provisions

These Terms govern the use of services provided by ESKOM AI Sp. z o.o. electronically via eskom.ai and subdomains, pursuant to the Polish Act on Provision of Electronic Services.

2. Services

Services include: informational website, client portal (authenticated), contact form, product demonstrations. Access to the portal requires SSO authentication.

2a. AI Services

Some of our services use artificial intelligence (AI) models provided by third parties. By using these services: • Data entered into the AI system may be transmitted to AI API providers to process the request. • AI providers follow a zero-retention policy — data is not stored after the request is processed. • ESKOM.AI applies automatic anonymization of personal data (GDPR/PII) before passing it to AI models, where technically feasible. • No ESKOM.AI AI system makes fully automated decisions that produce legal effects (Art. 22 GDPR). For details on data processing by AI, see the Privacy Policy §5-6 and §9.

3. User Obligations

Users must: provide accurate data, not misuse the platform, respect intellectual property rights, maintain account security.

4. Liability

ESKOM.AI provides services "as is". We are not liable for temporary unavailability due to maintenance. Maximum liability is limited to the contract value.

5. Intellectual Property

All content, logos, software and materials are owned by ESKOM.AI or its licensors. Unauthorized reproduction is prohibited.

6. Termination

Either party may terminate at any time. We reserve the right to suspend access for Terms violations.

7. Governing Law

Polish law applies. Disputes resolved by the competent court in Poland.
